Terms of Use Agreement
This Terms of Use Agreement ("Agreement") is a legally binding contract between you ("User") and ticura OpCo Ltd., located at 4 Bellows Road, Westborough, MA 01581, US ("Provider"), regarding the use of the Threat Intelligence Information Source analytics and curation solution ("Service") provided by ticura OpCo Ltd.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, you may not access or use the Service.
2. Limited Free Trial
The Service provided by ticura OpCo Ltd. is offered to User on a limited free trial basis, subject to the terms and conditions of this Agreement. The free trial period will be specified upon registration.
3. Scope of Service
During the free trial period, User may have access to some or all of the following features of the Service:
- Analytics and curation of Threat Intelligence information sources
- Recommendation of an optimal set of Threat Intelligence information sources
- Customizable curation of information feed
- Configuration of enrichers, filter categories, and consumption format
- Downloadable or consumable curated feed
- Access to the Search portal for easy navigation through 3rd party Threat Intelligence sources
Access to the Enrichment API is not included in the free trial and may be subject to separate pricing.
4. Subscription and Pricing
After the free trial period expires, User may choose to subscribe to the Service. Pricing details will be provided upon registration. Please contact ticura Support to get this pricing in place.
5. License Agreement
By using the Service, User acknowledges and agrees to comply with all terms and restrictions specified by ticura OpCo Ltd. Access to the Service includes the use of proprietary software and tools owned by ticura OpCo Ltd., granted under a non-exclusive, non-transferable license solely for the purpose of accessing and utilizing the Service.
6. Confidentiality and Data Protection
ticura OpCo Ltd. agrees to handle any confidential or personally identifiable information provided by User in compliance with relevant laws, including GDPR. User is responsible for ensuring it has the right to provide the information shared with ticura OpCo Ltd.
Providers Privacy Terms at https://app.ticura.io/privacy provide additional data handling and protection information for the Service and apply.
7. Liability and Disclaimer
ticura OpCo Ltd. is not liable for the accuracy, completeness, or availability of the information provided as part of the curated feed. User assumes all responsibility for the use and reliance on the information obtained through the Service.
8. Prohibition on Misuse or Harm
User agrees not to misuse, damage, or otherwise harm the Service, including any attempt to compromise its integrity, security, or availability.
9. Term and Termination
The free trial period shall commence on the date of registration and expire at the end of the specified trial period. ticura OpCo Ltd. reserves the right to terminate or modify the free trial at any time without prior notice.
Upon termination of the free trial, User's access to the Service will be suspended unless User chooses to subscribe to the Service.
10. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Delaware.
11. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements, whether written or oral, relating to the subject matter hereof.
12. Superseding Agreement
In the event of any conflict between the terms of this limited free trial and a dedicated Cloud Service Agreement entered into by the Parties, the terms of the dedicated Cloud Service Agreement shall prevail.
By accessing or using the Service, User acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
